The website provides information about our services and allows inquiries. An inquiry or receipt of a response does not, by itself, form a service contract or create an obligation to start work. Contracted services must be documented in a proposal, work order or agreement accepted by the parties.

2. Proposals and contracting

The initial offering includes business websites, business portfolios, personal portfolios, custom applications, AI chatbots, task automation and information technology solutions. Each proposal will define the functions, integrations, deliverables and exclusions of the specific service. Listing a service category does not mean that hosting, a domain, subscriptions, maintenance or access to internal tools is included.

Radical intends to serve businesses and individuals in the United States, the Dominican Republic and other countries. Each proposal will identify the client's country and, where relevant, state or province, the purpose of the engagement and the place of service provision. International service availability will be confirmed for the specific project. Payment, cancellation, review and support terms do not exclude applicable mandatory consumer rights. Radical's formation in Pennsylvania does not, by itself, mean that all engagements are governed exclusively by Pennsylvania law.

Before services begin, the contracting document must specify scope, deliverables, price and currency, applicable taxes, schedule, client dependencies, acceptance of deliverables and payment terms. Any change to scope or cost must be agreed in writing.

Proposal acceptance will be documented through express email confirmation from the client or an authorized representative, identifying the project and accepted version, and confirmation from Radical. Documents and terms incorporated into the proposal will be provided before acceptance. Radical will retain the corresponding proposal and both parties' acceptance emails. Work will begin once acceptance is documented and the agreed advance payment has been received, according to the project schedule.

For a conflict relating to a service, the specific accepted service agreement will prevail over these terms to the extent permitted by law. These terms do not replace that agreement or a mandatory legal obligation.

As a general rule, the client will be the account holder for domains, hosting and AI providers needed to operate the client's solution, and will bear subscription, renewal and usage costs. These costs are separate from the development price unless expressly included in the proposal. Management by Radical requires a specific agreement addressing included services, authorized access, billing, renewals, usage limits and handover or removal of access at closing. Management by Radical does not, by itself, change the client's account ownership. Any use of a Radical-owned account to operate the solution must be expressly disclosed and agreed, together with its costs and exit terms. This rule concerns the client's solution, not Ultron or Radical's internal accounts.

3. Website use

Website users must provide relevant information and be authorized to share other people's data or materials. They must not attempt unauthorized access, interfere with services, introduce malicious content or use the website for unlawful activities.

The form is not an agreed channel for sharing passwords, full payment card numbers or other sensitive data. If a service requires confidential information or credentials, the parties must agree on an appropriate channel and access before sharing them.

4. Access to client systems

Any work requiring access to client equipment, accounts or systems must be authorized and have a defined scope. The agreement must identify permissions, responsibilities, work windows, credential management and relevant backup measures. Sending an inquiry alone does not imply authorization to work on third-party systems.

5. Privacy, backups and retention

Data processing is described in our privacy policy. Services involving client data may require additional confidentiality and processing terms.

Corporate mailboxes have Microsoft 365 Backup with a configured three-month recovery window. This protects Radical's communications; it is not a contracted backup service for client systems. Deleting a message does not mean immediate removal from all copies.

Automatic deletion after 90 days is not promised. Contracts, payments, claims and other categories require separate retention and deletion assessment.

6. Artificial intelligence tools

Ultron is Radical's internal platform for carrying out projects. Client services do not include access, an account or direct use of Ultron. It currently uses the OpenAI API. Local DeepSeek is being prepared. Entirely local AI processing and zero data retention are not guaranteed.

An AI chatbot delivered to a client is distinct from Ultron. The corresponding proposal will identify the AI provider and account, who operates the solution, intended users, processed data, integrations, usage costs and responsibilities for notices, retention and handling requests. It is not presumed that all chatbots use Radical's internal account or that their users have access to Ultron.

Depending on project scope, Radical may work internally with instructions, code, documents and files provided by the client, including attachments in Ultron. The use of personal or confidential client information in AI features must be assessed and documented for the relevant service, including purpose, provider, data categories and applicable terms. The ability to attach files does not give blanket authorization to send all materials to an AI provider. Sending an inquiry does not, by itself, give blanket authorization for that use. AI outputs may contain errors and require human review before use in deliverables or decisions.

7. Materials and intellectual property

Each party retains its preexisting materials. Once the full price of the contracted deliverable has been paid, the client will have the right to use and modify it for the agreed purpose, for components over which Radical can grant those rights. The proposal will identify the license scope, inclusion or exclusion of source code delivery, and any agreed intellectual property assignment. The right to use and modify does not, by itself, imply source code delivery or intellectual property assignment. Third-party components remain subject to their licenses, which must be identified in the proposal. Radical retains its rights to Ultron, internal tools and preexisting components; where a preexisting component forms part of a deliverable, the proposal must grant the rights needed for its agreed use and explain any limits on modification. Contracting a project does not give the client access to Ultron. Sending an inquiry alone does not imply an assignment.

8. Payments, acceptance and cancellation

The standard advance payment will be 40% of the agreed service price, payable before work begins. It will be credited toward the total price; it is not an additional charge and is not automatically considered nonrefundable. The remaining 60% of the price will be paid when the client accepts the deliverables. Each project proposal will specify price, currency, tax treatment, the basis for calculating the advance payment, how acceptance is documented and payment due dates. Any different schedule must be agreed in writing. There will be no additional charges or scope expansions without written agreement. Recurring service renewals require express acceptance as described below.

The client will have 5 business days, counted from the business day following notification that the delivery is available for review, to review the deliverables and provide written comments relating to the scope. Business days are Monday through Friday, excluding United States federal holidays. The period may be extended by written agreement. Radical will correct deviations from the agreed scope; new features require a change agreement. Acceptance will be documented through express email confirmation from the client or an authorized representative, identifying the project and version of the accepted deliverables. Radical will retain that confirmation with delivery evidence. Silence does not constitute automatic acceptance or a waiver of legal rights.

The client may request cancellation in writing. Only work performed under the agreement and previously authorized, nonrecoverable third-party costs will be included in an itemized settlement, without duplicating costs already included in the work price. Before work begins, the proposal must define how performed work is valued: stages with agreed prices and progress criteria, or time worked at an authorized rate and within authorized limits. Payments received will be credited toward the settlement. Any excess advance payment will be refunded; if justified amounts exceed payments received, the balance will be invoiced under the agreement. There is no general cancellation penalty or rule making all payments nonrefundable. The excess will be refunded within fifteen business days of the agreed settlement, respecting applicable mandatory rights and deadlines.

These terms will be incorporated into a proposal accepted by both parties before services begin.

Each project includes 2 rounds of revisions unless a different number or allocation by stage is agreed in writing in the proposal and scope annex. A round consists of a consolidated list of client revisions to a presented version, within the contracted scope, and delivery of the revised version. An individual message or revision does not by itself constitute a round. Correcting defects in the agreed scope does not consume rounds. New features and additional rounds require a separate quote and written approval of the cost and schedule impact before work begins.

Maintenance is optional. The standard plan is month to month, with no minimum term, payable at the start of each period, with services and limits defined in the proposal and scope annex. Month-to-month renewal requires initial express acceptance of the price, renewal and cancellation terms; after that acceptance, it continues until cancellation is requested under these terms. This does not authorize automatic debits. The annex identifies the start and renewal date. The client may cancel by emailing [email protected] before the next renewal, without penalty. Cancellation takes effect at the end of the included or paid service period: service continues until then and the next period will not be charged. Radical will confirm in writing; the request date is when the email is received, even if the reply is sent later. Refunds follow the itemized settlement provided in these terms and the client's legal rights.

Terms of 3, 6 or 12 months require a specific agreement detailing price, duration, payments, renewal and early termination. Monthly payments do not turn a fixed-term commitment into a plan with no minimum term. No penalty or discount is presumed. Service renewal does not by itself authorize automatic debits: these require specific authorization and an enabled payment method. The proposal separately identifies development, hosting and maintenance, including which services end when each component is canceled.

Updates, backups, support and other maintenance tasks are included only as contracted. Clients may also request one-off work with scope, price and timing approved in writing before work begins. Purchasing maintenance is not required to receive the corrections at no additional charge described in section 9.

For the FAQ chatbot, implementation starting at USD 950 includes the first full month from activation. From the second period, the plan costs USD 149 per month and includes up to 1,000 AI responses and 45 minutes of adjustments per period, with no rollover. Periods follow the activation anniversary in America/New_York, using the last day when a month lacks that day. Cancellation may also be requested during the included month before the next renewal, without charging the next period. Final scope and implementation pricing are confirmed in the accepted proposal.

9. Availability and support

Projects include 30 calendar days to report defects in the agreed work, counted from the day following final delivery notified in writing. Radical will correct defects attributable to its work relative to the contracted scope at no additional charge. The client will report issues to [email protected] with enough information to examine them and without emailing credentials. The period allows issues to be reported; it does not require every correction to be completed within those 30 days. If a correction reported within the period remains pending when the period ends, Radical will continue at no additional charge until it is resolved. New features, scope expansions and maintenance services will be quoted separately and require agreement before billable work is performed. This period does not limit applicable mandatory rights or warranties.

The website and services may require maintenance or depend on external providers. Response times, hours, warranties, service levels and continuity commitments must be specified in the relevant agreement. These terms do not establish a guarantee of continuous availability, complete recovery or absence of incidents.

10. Liability and resolving differences

The parties may contact Radical to address an issue or difference and seek a solution, without limiting the exercise of legal rights. Any specific liability or dispute resolution terms must be included in the service agreement and comply with applicable law. Rights that cannot legally be excluded are not waived.

11. Updates and effective date

Effective date: October 23, 2026. Changes will not retroactively amend accepted agreements without the appropriate agreement or basis. The privacy policy and these terms must be published consistently with actual practices and the contracting mechanism.
